iPad by Apple: make sure to dot your “i”s and cross your “t”s

Forerunner in technological innovation matters in the past years, Apple once again drawn attention to itself by announcing the launching of the iPad, a tablet touch.


Besides criticisms as regards the handling of this product and its name ( "pad" being a synonym of "sanitary napkin" or "stuffing"...), many expressions of incomprehension arose concerning the lack of an in-depth research before choosing such a name.

Already when introducing the iPhone, Apple had to face the facts: it is not enough to find a name that is considered original and catchy by sales and marketing teams for it to be able of free use; a company still needs to ensure its availability, for example to avoid having to negotiate with Cisco and ICX Europe Limited, owners of prior trademark rights over the term iPhone in class 09.

As far as the iPad is concerned, it shall be noted that the Franco-Italian STMicroelectronics company is also the owner of the CTM iPad (since 2001), for goods of class 09 that deal with mobile phones, computers and computer peripherals. Moreover, IP Application Development LLC recently applied for this sign in connection with touch pads. In the United States, Apple will have to face Fujitsu to convince the USPTO to reject the application of the Asian firm (still jeopardized because of the similarity with the iPhone name).


The coexistence of the iPad trademarks will therefore also be subject to the signing of an agreement allowing Apple to use and register its mark, without announcing with regret the renaming of its newest. Let’s hope that the American company will learn the lesson after this second negligence.
