MONTENEGRO - New Decree on IP and trademark protection
The Montenegro Decree on IP rights was published in the Official Gazette No. 61 dated October 12, 2007 and came into force on October 20, 2007. the Decree regulates IP rights in Montenegro after its separation from the Union of Serbia and Montenegro on June 3, 2006.
All trademark rights registered with the Serbian trademark Office before the date on which the Montenegrin trademark Office becomes operational shall automatically continue to enjoy protection in Montenegro, i.e. without any re - registrations, registrations or payment of fees.
All trademark applications pending in the Serbian trademark Office before the date on which the Montenegrin trademark Office becomes operational must be re-filed with the Montenegrin trademark Office within six months from the said date.
The request for re-filing must be accompanied by a copy of the initial application and payment of tax (the amount of tax has not been set to date). All trademark rights registered before 3 June 2006 on the basis of International Conventions ratified by the former State Union of Serbia and Montenegro shall be valid in Montenegro.
All international trademarks registered for the territory of the Republic of Serbia on 3 June 2006 or later and before 4 December 2006 shall be registered by the Montenegrin trademark Office provided that the owner of the international registration files an application with the Montenegrin trademark Office within the term of 6 months from the date when the Montenegrin trademark Office becomes operational.
